Privacy Policy from Alfred Kornberger Foundation

1. Legal Basis
1.1. The new/current General Data Protection Regulation (hereinafter GDPR), the current Data Protection Act (DSG from 2000 and the amendment 2018), the Telecommunications Act (TKG from 2003) and the E-Commerce Act (Civil Code I No. 152/2001) address and regulate the right to information and protection of personal data.

2. Basic Framework Conditions
2.1. The Alfred Kornberger Foundation and its director Christian Czaak (born 21.02.1962 in Vienna; address: Bäckerstrasse 9 in 1010 Vienna; Austria) are responsible for compliance with all regulations listed under 1.1.

2.2. In this privacy policy, we inform you about what data we process and how we use it. We are fundamentally committed to protecting and securely storing all (personal) data entrusted to us. Within the scope of this privacy policy, we guarantee that your personal data will be processed and secured exclusively internally and will not be disclosed to third parties.

2.3. Your data will be collected, processed and stored and used in the context of reader/user, customer and business contacts, and specifically for the use of our content offerings, from processing inquiries to the possible fulfillment of contracts and billing, to content-related customer information/services such as electronic/internet-based services (e.g., possible future newsletters).

2.4. The legal basis for the processing of your (personal) data is accordingly based on compliance with and fulfillment of contractual, legal and statutory regulations and obligations, as well as on your transmission and consent via corresponding personal or written contacts (e.g. trade fair appearances or events of the Alfred Kornberger Foundation) or via electronic contacts (e.g. email, newsletter) or via the use of the Alfred Kornberger Foundation website.

2.5. Your data will be processed and stored for the duration of the entire user or business relationship—from initial contact (as a reader/user or customer) through any processing of business agreements and further customer services, up to the fulfillment and termination of a business agreement. This includes existing/current legal retention and documentation obligations based on the Austrian Commercial Code (UGB) and the Austrian Federal Fiscal Code (BAG), including any applicable warranty periods.

3. Use, Contact, Cooperation, and Data Processing
3.1. Depending on your use of and contact with the Alfred Kornberger Foundation, your data will be transmitted directly or electronically (e.g., via email or after proactive registration for a newsletter) for the purpose of processing and fulfilling your use of the website, your inquiries, and requests. This data will then be further processed and stored by us. Without your use and transmission of this data and without your corresponding declaration of consent, this data will not be collected, and without this data, we cannot process and fulfill inquiries and/or further business agreements and services, or comply with any necessary legal regulations (e.g., sections 2.3 and 2.5).

3.2. The processing of your data is based on the current legal provisions (see point 1.1. DSG 2000 and 2018, TKG 2003; § 96; para. 3, E-Commerce Act or ABGB I No. 152/2001; GDPR 2018; point 6; para. 1).

3.3. You can register to receive further/future information from the Alfred Kornberger Foundation through personal contact (e.g., trade fair appearances or events), via our website (email contact), or through telephone and electronic/internet-based contact (e.g., by email or after proactively subscribing to/via newsletter). Based on your use of the Alfred Kornberger Foundation website and your information/preferences, this transmission of information will take place electronically/internet-based (by email or newsletter) or (if expressly requested and separately communicated) also by telephone or post to the telephone number or address you have previously provided.

3.4. By using alfredkornberger.com, you, as the reader/user, also agree to be informed about new content offerings or other content-related activities of the Alfred Kornberger Foundation. Access to the Alfred Kornberger Foundation newsletter or alfredkornberger.com newsletter has always been and remains possible only through proactive registration by the user.

This consent can be revoked at any time. A clearly visible unsubscribe option is included in all newsletters at the bottom of each newsletter via a direct link.

3.5. If you do not provide us with your data in one of the forms listed (3.1, 3.3 or 3.4), then the transmission of information via the contact channels listed is not possible.

3.6. To stop receiving information, you can unsubscribe at any time, either in person or by phone using the number(s) listed on our website, or electronically via email using the email addresses also listed on our website, or by using the unsubscribe function included in any newsletter. The Alfred Kornberger Foundation is committed to processing your unsubscribe request immediately.

4. Electronic/Internet-based analysis methods and technologies
4.1. Our websites (websites) of the Alfred Kornberger Foundation use so-called tracking technologies such as cookies or analysis functions such as Google Analytics.

4.2. Cookies, specifically, are automated, software-based pieces of information that enable the recognition of individual users and the tracking of their browsing behavior on our editorial sections and websites. The use of cookies serves to make our websites more user-friendly and secure. For example, cookies measure the number of pages or sections visited and allow for corresponding improvements and adaptations to the navigation on our sections and websites.

4.3. By using our website, you consent to the use of cookies. You can refuse or withdraw your consent to the use of cookies via the settings in your internet browser. If you refuse cookies, the functionality and use of our website may be limited or completely unavailable.

4.4. These cookies are stored only as long as necessary for the regular use of the Alfred Kornberger Foundation and alfredkornberger.com as an independent content platform.

4.5. The use of the aforementioned technical tools also involves the collection and storage of technical data such as IP addresses (“Internet Protocol”). The individuals “behind” this data and their personal data are explicitly not collected or stored. This technical data is also not linked to other users.

5. Supplementary Information and Obligations (on the part of the Alfred Kornberger Foundation)
5.1. The Alfred Kornberger Foundation uses and stores your (personal) data exclusively on internal devices and storage media. The Alfred Kornberger Foundation undertakes not to disclose any (personal) data to third parties. Information is transmitted exclusively from internal IT devices and systems used exclusively by the Alfred Kornberger Foundation and secured with the latest technologies.

5.2. The Alfred Kornberger Foundation uses appropriate, up-to-date security measures to protect your stored personal data. This includes protection against loss, destruction, manipulation, or access by unauthorized persons.

5.3. You can request information about the use and storage of your personal data at any time—in person, by telephone, or electronically/via email. Furthermore, you have the right to rectification/updating of this data, to reduced/restricted processing/storage/use of this data, and to immediate deletion of this data at any time.

The lawfulness of the use and storage of personal data up to the point of withdrawal of consent remains unaffected by the withdrawal.

Excluded from restricted processing and deletion are any legal regulations or legal retention and documentation obligations based on the Austrian Commercial Code (UGB) and the Austrian Federal Fiscal Code (BAG), including any applicable retention periods (see also section 2.5).

5.4. 5.5. In the event of further changes to the legal framework, the Alfred Kornberger Foundation reserves the right to conduct its own review of the feasibility within a reasonable timeframe. This includes legal criteria (national and international) as well as organizational, technical, and financial feasibility, including the principle of proportionality.
